Terms & Conditions
1. Acceptance of Terms
By submitting a Request for Quote (RFQ), issuing a purchase order, or otherwise engaging NEXA Manufacturing Co. ("we," "us," or "our team") for manufacturing services, you agree to these Terms and Conditions. These terms govern all prototyping, production runs, and engineering services provided by our team.
2. Intellectual Property & Confidentiality
You retain full ownership of all intellectual property, including 3D models, CAD files, and proprietary designs submitted to us. We operate under strict Non-Disclosure Agreements (NDAs) to protect your data. However, our team retains all intellectual property rights to our proprietary additive manufacturing processes, workflows, and internal manufacturing methodologies.
3. Orders, Quoting, and Payment
All project quotes are valid for 30 days from the date of issue unless otherwise stated. For custom prototypes and new production runs, full payment or an agreed-upon deposit is required before production begins. For established commercial accounts, standard Net 30 terms may apply upon credit approval.
4. Manufacturing Tolerances & Specifications
We manufacture all parts according to the digital CAD files (.STEP, .STL, .OBJ) and material specifications provided by you during the RFQ process. We strive to maintain strict general tolerances in accordance with ISO 2768-1:1989 standards for additive manufacturing, welding, and casting. It is your responsibility to ensure that your design files are accurate and suitable for your intended application.
5. Returns & Remake Policy
Because all components and products are custom-manufactured to your exact specifications, we do not offer standard refunds or returns. If a delivered part fails to meet the agreed-upon dimensional tolerances or material specifications due to a manufacturing defect on our end, our team will remake the non-conforming part at no additional cost. Claims must be submitted within 14 days of delivery.
6. Limitation of Liability & End-Use
Our team produces custom components, including "sacrificial engineering" parts designed to fail under stress. You assume all risk and liability for the end-use, assembly, and testing of any parts manufactured by us. NEXA Manufacturing Co. shall not be held liable for any direct, indirect, incidental, or consequential damages—including equipment damage, lost profits, or personal injury—arising from the use or failure of our manufactured parts.
7. Shipping and Risk of Loss
All projected lead times are estimates based on current lab capacity. Risk of loss and title for manufactured items pass to you upon our delivery to the shipping carrier. We are not responsible for delays, damage, or loss caused by third-party freight or shipping providers.
